These terms and conditions ("Agreement") govern the use of the payment gateway provided on the company website, www.zygene.in ("Website") by ZyGene Biotechnologies’s Payment Gateway ("Provider"). By using the Website, you ("User") agree to these terms and conditions.

Fees:

The Provider will use commercially reasonable efforts to process payments promptly, but does not guarantee that payments will be processed within any specific timeframe.

Security:

The Provider will use commercially reasonable efforts to maintain the security of the Website, but does not guarantee that the Website will be immune from unauthorized access or use. The User agrees to use reasonable measures to protect the security of its User Account and the information provided to the Provider through the Website.

Termination:

Either party may terminate this agreement at any time upon notice to the other party. The Provider may also terminate this agreement immediately upon notice to the User if the User breaches any material term of this agreement.

Indemnification:

The User agrees to indemnify and hold the Provider harmless from any and all claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to the User's use of the Website.

Limitation of Liability:

The Provider will not be liable to the User for any indirect, special, incidental, consequential, or punitive damages arising from or related to the Website, even if the Provider has been advised of the possibility of such damages. The Provider's liability to the User will not exceed the fees paid by the User to the Provider for use of the Website during the six months preceding the event giving rise to the liability.

Governing Law:

This agreement will be governed by and construed in accordance with the laws of the Ernakulam, jurisdiction, without giving effect to any choice-of-law principles.

Entire Agreement:

This agreement constitutes the entire agreement between the parties with respect to the Website and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.

Modification:

The Provider may modify these terms and conditions from time to time by posting the modified terms and conditions on its website. The User's continued use of the Website after such modification will constitute the User's acceptance of the modified terms and conditions.

Assignment:

The User may not assign this agreement without the Provider's prior written consent. The Provider may assign this agreement without the User's consent.

Notices:

Any notice required or permitted to be given under this agreement will be in writing and will be deemed given when delivered personally, by email, or by certified mail, return receipt requested, to the parties at their respective addresses set forth in this agreement.

Compliance with Laws:

The User agrees to comply with all applicable laws and regulations in connection with its use of the Website, including but not limited to laws related to data privacy and security.

Intellectual Property:

The User acknowledges and agrees that the Provider owns all intellectual.

By using the Service, the user acknowledges that it has read, understood, and agrees to be bound by these terms.
